This Privacy Policy is designed to help you understand how Tuty Pty Ltd, (“Tuty” or “we”) collects, transmits, and stores information about our Users. The term “you” or “You” or “User” or “Users” shall refer to Students, Tutors or any person or entity who views, uses, accesses, browses or submits any content or material to the Service (defined below). This Privacy Policy is not a contract and does not create any legal rights. Providing your information is voluntary and your use of the Service (defined below) after the effective date of this document constitutes your acceptance of this Privacy Policy. If you do not agree to all the terms and conditions of this Privacy Policy, do not use the Service.

Information we collect

information you provide to us

This Privacy Policy applies only to information we collect via the website www.tutorsplus.com.au (“Site”), online and mobile applications (“Apps”) (the Site and Apps collectively referred to as, the “Service”), email, telephone, electronic devices and other interactive services. In order to help you get the most out of our service, we collect User submitted personally identifiable information (“PII”) when you use the Service. For example we may collect information you provide when you create an account, create or edit your profile, upload content (photographs, essays, lessons, etc.), provide profile descriptions or comments, provide school information for a student, participate in a contest or promotion, participate in interactive features of the Service, connect or communicate with us via third party social media sites, send us an email, request customer support or otherwise communicate with us or communicate with others users through the Service. Such information may include your name, address, password, zip code, email address, and phone number for communication purposes. Information may be submitted to the Site or Apps or via telephone or email when communicating with a Tuty representative. For students and parents, we may collect information related to your documentation of and payment for tutoring sessions; tutoring questions related to homework or your studies; teacher feedback of a student (once the parent provides consent for submission); and content you upload for the purposes of transmitting it to another user or for public display on the Site or Apps. For tutors, we may collect your Tax File Number (TFN) and date of birth, to complete a background check; we also collect content you upload for purposes related to transmission to other users or public display on the Site or Apps. As detailed in the “Data Transmission and Storage” section below, we use Secure Socket Layer (SSL) encryption on any page of the Site where we ask you to submit personally identifiable information and encrypt all such information for safe storage in our system.

Information we collect automatically

We also gather non-PII when you use the Service, including type of browser you use, access time, pages viewed, your IP address; and we collect information about the computer or mobile device you use to access the Service, including without limitation operating system and unique device identifiers and mobile network information. This data is used to better understand and enhance the user experience on the Site and phone. Tuty may publish these statistics or share them with third parties without including PII. Some browsers allow you to indicate that you would not like your online activities tracked, using “Do Not Track” indicators (“DNT Indicators”), however we are not obligated to respond to these indicators. Presently we are not set up to respond to DNT Indicators. This means that we may use latent information about your online activities to improve your use of our Service, but such usage is consistent with the provisions of this Privacy Policy.

Information we collect from other sources

We may also obtain information from other sources and combine that with information we collect through the Service. For example, we may collect information about you from other users, identity verification services, mailing list providers and publicly available sources. If you log into your account through sign-in services, like Facebook Connect or Google Authenticator, you provide Tuty with permission to access certain information about you such as your Facebook User ID, user profile, friends list, user graph and profile picture. User generated content posted through certain social networking preferences (e.g. pages you “Like” or “Follow”) may be viewed by the general public. Accordingly, Tuty cannot ensure the privacy of any PII included in such User generated content.

Location information

When you use the Service, a location feature exists whereby it will automatically collect your geolocation information. In such event, the Service will use and share such location to enable users to determine which users in their network are nearby. Tuty may also use location information to provide information and advertising to users. IF YOU WANT TO STOP THE AUTOMATIC COLLECTION OF YOUR LOCATION INFORMATION, YOU MAY DO SO BY USING THE PRIVACY SETTINGS ON YOUR BROWSER AND/OR ON YOUR DEVICE. FOR MOBILE APP USERS, YOU MAY ALSO UNINSTALL THE APP.

Data transmission and storage

Tuty uses industry-standard 128-bit SSL encryption when collecting and transmitting your information through the Site and the Tuty network (collectively, the “System.”) Once information has been collected, we encrypt sensitive data in our database for added security. Tuty also uses firewalls and hardware monitoring across our System to protect against unauthorized access. Unfortunately, even with these measures, Tuty cannot guarantee the security of PII. By using the Service, you acknowledge and agree that Tuty makes no such guarantee, and that you use the Service at your own risk.

Financial information

If you elect to pay for tutoring lessons with a credit card, we will collect your name, credit card number, expiration date, and address information associated with the account. All financial information, other than credit card numbers, is stored and encrypted in our System in full compliance with the Payment Card Industry Data Security Standard. We do not store credit card numbers.

With Your Consent

We also may share your Personal Information with a third party if you consent to the sharing.

How We Protect Information

Tuty uses SSL (Secure Socket Layer), the industry standard method for computers to communicate securely without risk of manipulation or recipient impersonation. We utilize SSL in the online registration process, in the login process, and in the account management section of the Site.

Tuty uses strong encryption technology to protect sensitive information.

Tuty employs firewalls, intrusion detection systems, and system monitoring to protect against unauthorized access of our systems.

Your user accounts are also protected by the password you use to access your online account with Tuty, and we urge you to take steps to keep your password safe. If you feel your password has been compromised, you should change it immediately by logging into your account. After you have finished using our Site, you should log out of your Tuty account and exit your browser.

WE TAKE THESE PRECAUTIONS IN AN EFFORT TO PROTECT YOUR INFORMATION AGAINST SECURITY BREACHES. HOWEVER, THIS IS NOT A GUARANTEE THAT SUCH INFORMATION MAY NOT BE ACCESSED, DISCLOSED, ALTERED, OR DESTROYED BY BREACH OF SUCH FIREWALLS AND SECURE SERVER SOFTWARE. BY USING OUR SITE, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO ASSUME THESE RISKS.

Changing or Removing your Personal Information and Closing your Account

If the Personal Information you provided when you registered changes, you may update this information by logging into your account and accessing your account settings. If you would like to remove some of the Personal Information you have posted on the Site, such as information you posted in profiles, you may do so by editing or deleting that item. To request removal of other Personal Information you have voluntarily posted on our Site, such as information you may have posted in online group forums, contact Tuty. In some cases, we may not be able to reasonably accommodate your request to remove your Personal Information, in which case we will let you know if we are unable to do so and why.

If you no longer wish to participate in our Services you may close your account directly in the account settings portion of your account.

If you close your Tuty account, we have no obligation to retain your information, and may delete any or all of your account information without liability. However, we may retain information related to you if we believe it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, Non Personal Information, account recovery, auditing our records, enforcing our rights and obligations under our agreements or if required by law. Tuty may also retain and use your information if necessary to provide the Services to other Registered Users. For example, just as an email you may send to another person through an email service provider resides in that person’s inbox even after you delete it from your sent files or close your account, emails you send to others through Tuty to other Users, as well as your contributions to Tuty groups, may remain visible to others after you have closed your account. Similarly, other information you have shared with others, or that others have copied, may also remain visible. Tuty disclaims any liability in relation to the deletion or retention (subject to the terms herein) of information or any obligation not to delete the information. Tuty does not control when search engines update their search index or cache, which may contain certain job post, profile or other information that has since been removed from Tuty’s Site.

Changes to our Privacy Policy

Tuty reserves the right to change this policy and our Terms of Service at any time. We will notify you about significant changes in the way we treat Personal Information by sending a notice to the email address registered in your account, or by placing a prominent notice on our Site, so that you can choose whether to continue using our Services. Significant changes will go into effect 30 days after we notify. Non-material changes or clarifications will take effect immediately upon posting of the updated policy on our Site. You should periodically check our privacy policy for updates. Your use of the Site or the Services after such effective date will constitute acceptance by you of such changes.
